Görevde yükselmede yüksek puan alan düşük dereceli kadroya atanabilir mi?
Soru: Üniversitede bilgisayar işletmeni kadrosunda çalışıyorum. Yapılan
görevde yükselme sınavında ikinci oldum. Altı adet 5. dereceden şef kadrosu
olmasına rağmen çalıştığım birim 6. dereceden açıldığı için atamamı 6. dereceye
yaptılar. İki soruya cevap verirseniz çok sevinirim. 5. ve 6. derece arasında
hiç bir fark olmadığı doğru mudur? Doğru değilse ne gibi farklar var? Fark olmasa
dahi ikinci sıradaki birini 6. dereceye 15. sıradakini 5. dereceye atamaya hakları
var mıdır? Hakkım ihlal edilmişse nasıl bir yol izleyebilirim?
Cevap: Yükseköğretim Üst Kuruluşları ile Yükseköğretim Kurumları Personeli
Görevde Yükselme ve Unvan Değişikliği Yönetmeliği, tüm üniversitelerin ortak
yönetmeliğidir.
Bu Yönetmeliğin 14 üncü maddesinde, "Görevde yükselme suretiyle ilan edilen
boş kadro sayısı kadar atama yapılmasında başarı puanı esas alınır. Başarı puanı,
şube müdürü, müdür ve bunlarla aynı düzeydeki diğer kadrolara atanacaklar için
yazılı ve sözlü sınav puanlarının aritmetik ortalaması; diğer kadrolara atanacaklar
için yazılı sınav puanı esas alınmak suretiyle tespit edilir ve kurumların resmi
internet sitesinde ilan edilir." hükmü vardır.
Aynı Yönetmeliğin 15 inci maddesinde ise, "Atanmaya hak kazanan personel, başarı
sıralaması listesinin kesinleşmesini müteakip üç ay içinde en yüksek puandan
başlamak üzere belirlenen başarı sıralamasındaki başarı puanlarına göre atanır."
denilmektedir.
Bu hükümler Genel Yönetmelikteki hükümlerle uyumludur. Üniversite, görevde
yükselme sınavında başarılı olan ve diğer atanma şartlarını taşıyan personeli,
başarı sıralamasını esas alarak, uygun kadrolara atayacaktır.
Bu atamalarda, genel hükümler de dikkate alınacaktır. Genel hükümler şu şekildedir:
657 sayılı Kanunun 45 inci maddesi:
"5 inci ve daha aşağı derecelerdeki kadrolara (5-15), derece yükselmesi için
gerekli nitelikleri haiz memur bulunmaması hallerinde, 36 ncı maddede belirtilen
öğrenim durumları itibariyle tespit olunan yükselinebilecek dereceyi aşmamak
ve karşılık gösterilecek kadro derecesi kazanılmış hak aylık derecelerinin
üç üst derecesinden fazla olmamak kaydıyla, bu dereceler karşılık gösterilerek,
kendi derecesi ile aynı sınıftan memur atanması mümkündür."
657 sayılı Kanunun 76 ncı maddesi
"Kurumlar, görev ve unvan eşitliği gözetmeden kazanılmış hak aylık dereceleriyle
memurları bulundukları kadro derecelerine eşit veya 68 inci maddedeki esaslar
çerçevesinde daha üst, kurum içinde aynı veya başka yerlerdeki diğer kadrolara
naklen atayabilirler. Memurlar istekleri ile, kurumlarında kazanılmış hak
derecelerinin en çok üç derece altında aynı veya başka yerlerdeki kadrolara
atanabilirler."
Kurumlar başarı sıralamasına göre atama yaparken, bu kadroların derecelerini
de en yüksekten başlayarak sıralamak zorunda değillerdir. Örneğin Üniversite,
daha yüksek puan almış birini daha düşük dereceli bir kadroya; daha düşük puan
almış birini ise daha yüksek dereceli bir kadroya atayabilecektir.
Hatta, daha yüksek puan alan adayın açıkta kalmamasını sağlamak için böyle
ayarlamalar mutlaka yapılmalıdır.
5. dereceli ile 6. dereceli şef kadrosu arasında kayda değer bir mali fark
bulunmamaktadır. 5682 sayılı Pasaport Kanununa göre, 1., 2. ve 3. derece kadrolarda
bulunan Devlet memurları ile diğer kamu görevlilerine hususi damgalı pasaport
(yeşil pasaport) verilebildiği düşünüldüğünde, bu konuda da bir fark bulunmamaktadır.
